I don't see any logic in Nick's behavior at all.
Fucking with Kurt, Sean, Nate and doing all that while trying to stream an ongoing court case.
I recently updated a friend on the Supertips system and this issue. Her response was great.

"Oh, yeah, and that's always worked. Fucking around with a bunch of lawyers with a sketchy, janky AI system that's not been legally tested by a guy on probation."

The irony is that the Supertips system could work, and it can be very, very funny. Whoever is writing all those Ronnie O'Neal Supertips on Nick's stream is hilarious. He/she is far funnier than Nick will ever be.

Alphabet/YT should replicate it with a proper TOS. IANAL, but I imagine that would involve a combination of: flashing words on-screen that say 'This is AI parody!', permission from those being parodied, a proper cut to the platform hosting and/or those being parodied, etc.

Not a dumb question. The answer is twofold.

1) What @Strix454 said, and the AI answer is accurate. It jives with my deep dives into MN law and Reddit (r/probation) in which people discuss it.

2) Problem: It's a pretty opaque system. The questions must be asked,
  • How are POs incentivized?'
  • Does the system want to go through the headache of doing any of these things if Nick violates his probation?
Kandiyohi County freely publishes its stats, which are compatible with most people on probation throughout the state.

For those on probation for 4 years (no stats for 5 years), the "success" rate is about 70%. It's a little unclear what happens to the 30% who fail.

For Nick, I could go both ways on the matter.

- On one hand they might be more vigilant and strict because he's pissed off virtually everyone in the County and has 5 kids.

- On the other hand, he's a litigious little fuck with a trust fund and no one wants the headache.
 
And if he gets totally and hopelessly off the rails and will not cooperate with them at all, the ultimate final threat is to impose the original sentence on him which would involve actual prison. But its the last resort.
The ultimate penalty would be if they not only did that but threw on more criminal charges for whatever crime he committed that violated probation, and also threw in other criminal charges for violating probation itself, then sentenced him consecutively for all of them.

(This isn't going to happen unless he murders someone or something, but at least in theory, you can actually end up worse off for having taken a deal and fucking it up than if you'd gone to trial and completely lost.)

IANAL (there are people in this thread who are) but the 28 day prison sentence isn’t something that happens if he violates probation, it is something that is happening and may be deferred if he doesn’t violate probation. As of right now, he is to report to prison on Aug 1.

I'm not sure what kind of oversight they're doing on Nick, but just from his current behavior, the 28 days in jail is a real possibility. I mean I don't know what's in the water up there in Minnesota because they seem pretty weak on this stuff but he's really on thin ice and they can do it.

They probably should, to get this skinny faggot's attention.

Especially if they don't put him in jail right away. Logical? No. But he's an addict. I never see anyone talking about him failing probation multiple times. It always ends with 28 days in jail and nobody talks beyond that for the rest of the 5 years. Made me Inquire
 
Here's my prediction. Nick's set is going to be cringe as fuck. He's clearly not sleeping (possibly genuine PTSD by having his career nuked, not even meming) and abusing modafinil and Adderall to compensate.

It's going to catch up to him, hard. The nervousness or excitement of stage work is going to punch his narcolepsy into overdrive. He'll either be nearly asleep on stage or abuse the above drugs hard, overcompensate and be jittery as fuck.

We can only hope MNPublicRecords has something salacious to puff up the day.

The 28 days thing is temporary. On or possibly before August 1, when the jail time starts if they impose it, that's what he's looking at. So if he fucks up (actually he is already fucking up) and/or they're just not happy with his behavior, he goes to jail on that day.

After that, they may defer it. I'm not sure whether they have the option of waiving it entirely at that point or if it stays there.

The system is weighted toward bringing the person back into compliance with their probation. Someone like Nick can get away with a whole lot before they fully drop the hammer on him. The PO can make Nick's life hell in various progressively more annoying ways. Nick has to show minimum compliance with the probation process to avoid the worst-case outcomes.

But its less that the system is opaque than it is rather arbitrary. Alot of the time is down to the individual Probation Officer and to a lesser extent the judge. Someone like Nick really lives at their mercy in the process.
