The Trump administration insisted Sunday that it has no legal obligation to arrange for the return of a Maryland man illegally deported from the United States, arguing that a Supreme Court ruling last week only requires officials to admit him into the country if he makes it back from a high-security prison in El Salvador.

Justice Department lawyers told a federal judge that they don’t interpret the Supreme Court’s Thursday ruling — that the administration “facilitate” Kilmar Abrego Garcia’s release — as obligating the administration to do anything more than adjust his immigration status to admit him if El Salvador’s government chooses to release him.

With El Salvador’s President Nayib Bukele set to meet President Donald Trump Monday, DOJ attorneys argued the courts have no power to require the administration to engage with the Salvadoran government to reach a diplomatic solution. They contend such a potential order would amount to a violation of the separation of powers and an intrusion into what they allege is unfettered presidential power to conduct foreign relations.

“All of those requested orders involve interactions with a foreign sovereign — and potential violations of that sovereignty,” Justice Department attorneys wrote in a seven-page submission to U.S. District Judge Paula Xinis. “[A] federal court cannot compel the Executive Branch to engage in any mandated act of diplomacy or incursion upon the sovereignty of another nation.”

The administration’s position suggests officials do not view the Supreme Court’s order as compelling them to seek Abrego Garcia’s return. The Salvadoran native entered the country illegally around 2011 and had been living in Maryland. The Trump administration has admitted it deported him to El Salvador in violation of a 2019 immigration court order barring his deportation to that country. Though Abrego Garcia was denied asylum, a judge found he could not be sent to his home country because of a legitimate fear of persecution by a local gang.

The administration continued Sunday to flout a Friday order from Xinis to deliver “daily updates” to the court describing its efforts to return Abrego Garcia to the United States. Sunday’s update from Evan Katz, the assistant director of removal operations for Immigration and Customs Enforcement, said the administration had “no updates” for the judge. A day earlier, in a similarly threadbare update, the administration turned to Michael Kozak, the State Department’s senior bureau official in the Bureau of Western Hemisphere Affairs, who said Abrego Garcia was still alive in El Salvador’s CECOT prison.

The administration is also bucking demands from Abrego Garcia’s attorneys that officials detail the arrangement to ship hundreds of foreign nationals to a notorious prison in El Salvador. One of the Sunday filings insists those details are classified and could be subject to attorney-client and state secrets privileges.

“It would be inappropriate for this Court to hastily order production of these sensitive documents,” Justice Department lawyer Drew Ensign wrote.

The administration also said it would resist efforts by Xinis to demand testimony from officials about their thinking on Abrego Garcia’s potential return, saying such disclosures “could interfere with ongoing diplomatic discussions — particularly in the context of President Bukele’s ongoing trip to the United States.”

Still, the administration’s narrow view of its obligations under the Supreme Court’s ruling appears to up the stakes of a hearing Xinis has scheduled for Tuesday afternoon to assess the steps officials are taking to arrange for Abrego Garcia’s return.

“We’re going to move. There will be no tolerance for gamesmanship or grandstanding,” the judge said. “There are no business hours while we do this. … Cancel vacations, cancel other appointments. I’m usually pretty good about things like that in my court, but not this time. So, I expect all hands on deck.”

The wife of Kilmar Abrego Garcia, the alleged MS-13 gang member whose deportation has become a hot issue on Capitol Hill, said she “acted out of caution” by filing for a protective order against her husband after she accused him of beating her.

Jennifer Vasquez Sura said Wednesday that she sought the 2021 restraining order because she was a past survivor of domestic violence and wanted legal protection “in case things escalated.”

“Things did not escalate, and I decided not to follow through with the civil court process,” Ms. Vasquez Sura said about the order she petitioned in Prince George’s County, Maryland. “We were able to work through the situation privately as a family, including by going to counseling.”

She said her marriage to Mr. Abrego Garcia “only grew stronger” in the years that followed.

As for the restraining order, she said “that is not a justification for ICE’s action of abducting him and deporting him to a country where he was supposed to be protected from removal.”

Mr. Abrego Garcia, 29, was deported to El Salvador’s terrorist prison last month. The illegal immigrant and suspected gang member was aboard one of three planeloads carrying other alleged gangsters, most of whom were affiliated with the Venezuelan criminal outfit Tren de Aragua.

Democrats have portrayed Mr. Abrego Garcia as a victim of the Trump administration’s sweeping crackdown on illegal immigrants.

Much of their concern is centered on a 2019 immigration order that found him to be in the country illegally but barred him from being sent back to El Salvador because he was in danger of being targeted by local gangs.

The same immigration court found credible evidence that Mr. Abrego Garcia was a member of MS-13.

A Prince George’s County police investigation cited by the court said Mr. Abrego Garcia was wearing clothing associated with Hispanic gang culture and had an assigned rank in MS-13’s hierarchy.

Sen. Chris Van Hollen, Maryland Democrat, flew down to meet Salvadoran leaders and persuade them to free the “illegally abducted” Mr. Abrego Garcia from the Terrorism Confinement Center, or CECOT.

Mr. Van Hollen met with El Salvador’s vice president, though no release agreement was made.

Salvadoran President Nayib Bukele said during a White House meeting this week that it would be “preposterous” for him to return the suspected gang member to the U.S.

The Department of Homeland Security, in a further attempt to combat Democratic messaging around Mr. Abrego Garcia’s deportation, shared details of the May 2021 protection order his wife filed.

Ms. Vasquez Sura said in the petition that Mr. Abrego Garcia “punched and scratched her eye,” which caused her to bleed.

She also said she tried to leave the house to run an errand until her husband “got angry,” yelled at her and ripped off her shorts and shirt.

“At this point I am afraid to be close to him,” Ms. Vasquez Sura said in a statement provided in the petition. “I have multiple photos/videos of how [violent] he can be.”

The temporary restraining order was dismissed in June 2021 after Ms. Vasquez Sura did not show up to court.

After sharing the court documents, the DHS said, “This MS-13 member is not a sympathetic figure.”

It does not seem so. The immigration trial took place in 2019, where it was decided he should be deported, but not to El Salvador.

I have found this source that explains a lot of the details, although there is a bias (emotional storytelling "But on that afternoon, while driving with his disabled five year old in the backseat, Abrego Garcia was pulled over by ICE officers, apparently without a warrant."), but it does link to court documents which you can read yourself.

I have found that, while it is true that there does not seem to be a strong source that he is MS-13, the burden of proof for an illegal alien is on the alien ("has not demonstrated that he is not a danger to property or persons", from appeal for his deportation).

I would also like to find more on the source that he is MS-13. That is for personal curiosity because it would be even funnier if so many people are fighting to much to protect a gang member.
But it doesn't matter if he is a gang member or not. The point is that he was illegally in the country, and never even attempted to claim asylum (not until he was caught, many years later). All the evidence of his persecution in El Salvador comes from his family (of course they could not possibly know what to say to protect him, not like there aren't thousands of tiktoks and youtube videos teaching people exactly that).

Didn't this dude have an American wife and kids. I don't why he didn't at least try to gain citizenship or a green card or fucking something based off of that alone, but that's on him. The US shouldn't have any obligation to hold someone who isn't a US citizen to the standards we expect, imo.
