What a revenge porn depends on more than anything is actual revenge porn having happened. Revenge porn laws came about in part because of situations where someone puts up images of someone else on the internet. Its considered especially damaging because once the images get out, there is no way to stop their spread.

But Aaron's case is a somewhat unique situation where the act of "revenge porn" was the distribution of a photo to one person without any act of public distribution at all. The prosecution can't present the actual "revenge porn" at trial because it no longer exists. The case depends on the memory of one or two witnesses who saw the image. Its also an open question of how much damage could possibly have been done to a victim through this particular sort of revenge porn.

More normal cases of revenge porn are really straightfoward to prosecute and don't present a whole lot of opportunities for a person to beat the charge. You have the image. You have to prove that the person was responsible for distributing the image. For the felony, you have to prove things about their motives. But that is about it.
