Whether or not this is the case, the very fact of going around deliberately deleting things that absolutely contradict what you just claimed in a lawsuit you just filed can result in the finder of fact drawing an adverse inference, at the very least.

It's astoundingly stupid and incompetent practice, just what I'd expect from KUSK. Profoundly unprofessional.

Deleting it before filing would have been bad enough, but deleting it after filing, because you apparently read your own thread, doesn't just make you look sleazy and disingenous, but stupid as fuck on top of that.

Maybe they're hoping Ron Coleman pulls a Ty Beard somehow. Good luck with that.

Not unless opposing council filed something to stop them, but they would have done so as a matter of course. However I do think it's somewhat helpful to the opposing party in this case, they now know exactly what tweets are incriminating and helpful for their case and can ask twitter to supply them to council. Deleted doesn't mean "deleted" when it comes to most social media.

No it was planned, in Smash JT's video they point how Sweet Baby Inc and other DEI companies have also deleted their tweets the same day when Alyssa deleted hers.

This also means that Alyssa is probably deeply connected to these DEI companies.

I think for a lot of console players it was their introduction to that style of game with all the branching conversations and your-choices-have-consequences stuff and that's what made it stick out. If you were primarily a PC gamer at the time I can't imagine being too impressed.

I played a bit of 1 and 2 and the combat was total ass so I lost interest pretty fast.

As I understand it, spoliation of evidence is never allowed, but it's not an automatic lawsuit forfeit (or automatic jail). Someone expecting legal action has an obligation not to destroy or alter evidence, but there can be debate as to exactly when that obligation took effect, what it encompasses, and how much destroying/altering evidence prejudiced the lawsuit.

So I think the notice letters are more about making it very clear that they have an obligation to preserve, and explicitly listing as many relevant items as possible, so they can't claim ignorance later.

Alyssa & friends nuking texts after the lawsuit filing (or even immediately before) seems pretty clear cut, but opposing counsel has to know that evidence existed, know whose possession it was in, contact the real people behind those social media accounts, and establish in court they had a legal obligation to preserve. So those Black Girl Magic Gamerz groups or whatever nuking their histories with Alyssa aren't automatically in trouble, unless someone sends Coleman their incriminating posts and he decides to pursue them.
