Your point is taken, and perhaps my response seemed a bit hostile at the outset. It was not my intent to do so, but that was a result of misapprehension of your intent.

I was thinking and speaking narrowly in terms of the strict rules guiding the legal process that (IMO) clearly show Nick's arguments to be worth less than the paper they were printed on. Apply the rules fairly, and you get the current result. I initially took your post as an indication that the results of the search dictated your opinion on the rules (i.e. if he's innocent the rules are fine, but the rules are wrong if he is guilty).

On the more practical (and less autistic attention to detail) level, I agree that laws are shaped by society and general opinions to some degree. I also agree that they should be responsive to some degree, otherwise you get heaps of useless rules.

I think Nick got as fair as shake with the law as anyone in Minnesota would, and I do not have any reason to think that he or anyone is getting railroaded by the State using this rule. I share the general concern regarding the State getting benefit of a doubt in warrant applications.
