Interesting new matter of public record attached. Attempting to decipher the bizarre tweets yesterday could benefit from some context: if that 4:23 timestamp in your screenshot is Nick's timezone (or anything close), then it would have been shortly after leaving his CHIPS pretrial hearing with Judge Hanson (no longer Helgeson) at 3:00 PM CST yesterday. The seemingly spiraling tone of the tweets makes one wonder if perhaps that hearing didn't go very well for him, so let's take a look at exactly what Nick tried to accomplish there, shall we?
Apparently, at 3:43 PM on Friday just one business day before the hearing with little chance for the state to respond, and with no affidavits building a record or even so much as a proposed order, Nick's crack legal team slipped in a motion revealing that after the Rekietas took those oft-mentioned May hair follicle tests and then oddly revoked MMI's consent to disclose those tests' results to any state agency, the Guardian ad Litem (GAL) somehow managed to get her hands on those results anyway and also gave them to other parties. Because the Rekietas apparently took those May hair follicle tests at the suggestion of their then-counsel, the motion cites to "attorney work product doctrine" to beg the judge to deem those test results inadmissible as evidence and also order all parties to never ever ever speak of them again. Oh, and the motion also asked that the GAL be fired for her dastardly deeds obtaining that highly relevant information in the first place. Anybody want to hazard a guess as to why Nick would try so very hard to suppress those test results if they came back negative?
As you'll see from the motion, Nick also appears to think he's done more than enough work on his case plans for the judge to simply order that the kids can move back in ASAP, or at least order that the grandparents and children can all move into Nick's home, which would seem pretty crowded unless that plan would include Nick and Kayla simultaneously moving over to April's house or elsewhere. Nick's also apparently seething enough for the motion to
yet again ask the judge to unilaterally order the presumptively public case file to be made confidential across the board because he's such a grandiose "public figure" deserving special treatment, even though a judge already refused the same request weeks ago (in a denial previously on here at Post #111,393) and had deferred that issue to a motion and hearing that's already been scheduled to August 9th.
The result? Sadly there's still no written order as yet and it's possible that there was only a ruling from the bench or various things taken under advisement, but as you'll see in the attached, it at least doesn't seem like Judge Hanson agreed to firing the GAL so far, as she followed up with filing her trial exhibit list later in the afternoon than the hearing. It also doesn't seem like Judge Hanson agreed to exclude the May hair test results either, as the GAL's filing later that afternoon planned to introduce the results at trial. Nor does it seem like Judge Hanson was very receptive to the idea of returning the kids to the parental home immediately, and instead the trial was simply postponed from late July to late August for some reason. Nor does it seem like Judge Hanson agreed to unilaterally seal the file this time around either, because we're still sitting here looking at it. Better luck next time, Nick!
Going to guess Nick was at least periodically helping himself to their meds.
I'll leave it to the few lab geeks ITT to elaborate, but the most common test panels that would detect adderall, dexedrine, vyvanse, etc. don't ordinarily detect ritalin, so we can only speculate. Of course, Nick could just as easily put an end to any baseless speculation in that regard by simply going on stream to own the haters by walking us through his surely negative hair test results once and for all, rather than publicly begging a judge to bury them. How does someone supposedly so ensconced in internet culture as Nick somehow behave in a manner so oblivious to the Streisand Effect?
