The courts of Australia have determined that a person I know is personally liable for over $400,000 in defamatory damages to Liz Fong-Jones.

Vincent is Australian. He owns a company called Flow Chemical Pty Ltd in Australia. The Australian RIR, APNIC, leases him a few IP addresses. Those IPs have been used by my American company 1776 Solutions, LLC to host various web services. Among those services has, at various times, been the Kiwi Farms, a website of Lolcow, LLC in the US. Kiwi Farms hosts comments from users all over the world.

Victoria courts have determined that both his company and _him as a person_ are liable for close to half a million dollars in damages for statements made by anonymous users on a web forum owned by a company hosted by a company leasing IP space from his company, regardless of their truth or accuracy. This judgement was made in default in his absence because apparently he felt the entire thing was stupid and would be thrown out without him doing anything.

This loss amounts to nothing for me. I have not been able to reliably use these IP addresses in over a year because Liz Fong-Jones has been harassing any ISP they route through. I also have no stake in Flow Chemical Pty Ltd, so I am not at risk. I can just get new ones at any time in the US.

However, this is obviously unbelievably fucking retarded and evil. I'm not going to let a gross tranny fuck over good people. I am looking for references to attorneys in Australia who would be willing to help overturn this absolute travesty. <jcmoon@pm.me>

The precedent being set in Australian court should terrify anyone living there. You are now personally liable for eating shit for anything anyone says, even if it is the truth, if you are within 3 degrees of separation of them.

I might disagree with him on a lot of things, but I respect the man because he is principled enough to stand up for what he believes in. The fact he has no assets to threaten makes it easier for him, I'm sure.

He didn't even host it. His company only provided IPs. It's like if my phone gets service from ATT and I called my friend and told him that Dongless is a rapist, then Dongless sued the CEO of ATT for providing me a phone number.
 
That decision is a fucking travesty, while the guy was foolish to not respond to it and leave it in the hands of the phenomenally cucked descendants of convicts that is the Australian Courts, the Idea that he is responsible for anonymous users, many in a country that actually has Constitutionally protected free speech, repeating the admission of sexual assault Liz Dong Gone made himself is beyond fucked.
If the world was sane it would have been laughed out of court, things being what they are I hope he is given his day in court to appeal it.
The truth is absolute defense against defamation, I look forward to seeing Brick Face have his Consent Accident tweets and admissions to Tort Interference entered into the Court Records.
This Vincent dude missed his chance to have this thrown in Dongs face which is a shame but this shit is as grossly unfair as Elliots face is grossly square and it shouldn't stand without challenge.

He made it known he'd be there and issued an invitation for the public to attend. I don't think for a minute that he was scared. I think he was angry that the photos showed how few people turned up. You'd think a well regarded activist would attract more of a crowd.
 
Okay I'm an absolute retard who knows better than to think my leisurely viewing of some high profile court cases endows me with legal knowledge, but:
Wouldn't the fact he's complaining about an Australian company facilitating mean comments from a US-based company mean that the US-based company takes precedent here since they're the direct host of the content, and thus some US law should apply? I.E, the fact the crux of it all is that KF is the source of the defamation, section 230 should apply? That would be an argument to be made I suppose, but there was no opposition on the assumption the courts would've thrown it out.

Maybe some lawkiwi can explain it to me because I kind of understand interstate lawfare in the US but international is another thing entirely.

If a precedent has been set, does that mean that Google and Honeycomb can be sued for having an employee use company property to rape people and commit cyber attacks?

Can their own tactics be used against them?
