Anyway, a couple questions for the legal Kiwis:

If the court grants the motion to compel arbitration (with dismissal)
Greer will appeal, but what could he gain? His complaint was very specific that he wanted to get on the celeb judging round for season 17. By the time he appeals, celeb judging will be over. The court can't go back in time and grant his wish. So what would the appeal be for? Could he roll his request forward to season 18?

If the court doesn't grant the motion to compel
IIRC Fremantle gets 2 weeks to respond to the request for preliminary injunction.
  • Does Greer then get a chance to respond?
  • And then Fremantle gets to respond to his response? How much time would they get?
  • Then another wait for the court to respond?
It just seems like with all those responses and counter responses, that could put them into May, and that would really be cutting it close. The original Accommodations might not be available for rehearsal, let alone the actual show. Especially since they'd have to go to Los Angeles for it. LA is only a quick flight away, but I'm guessing they'd have to be there for a full day, if not longer.

I hope it drags on and on, every day is another day greer sits looking at the clock, checking his phone and emails feverishly fretting.

This time next year could be deja-vu...hype, audition, rejection, court.

But is that was he was really doing though? I mean yeah, he is Russell Greer, so he was confused. But when I read his filing, my first thought was that he was trying to be clever and get a face-to-face with the judge under the guise of "Golly, I'm just a pro se litigant who doesn't understand anything." Get his foot in the door and explain all his plights, and how urgent this is (because clearly she doesn't understand that yet), and then try to pressure/guilt/manipulate her into making a decision, or at least say when she will make a decision. She would allow none of that or course, but that's Greer's m.o.: do anything to get his foot in the door. He has boundless faith in his powers of persuasion.

I don't know. Maybe I'm giving him too much credit for strategizing. Or maybe I'm too skeptical.

You can tell he's desperate now, with the "next steps" motion. He points out filming has started, and is clearly grasping at straws when he says he could still perform before the celeb panel if the judge would hurry and do her job and grant the injunction! I wonder if he had a fleeting glimmer of lucidity, and realized if he loses his suit, Marathon probably won't let him audition again. Then again, that seems like it's rather far for him to think ahead. It's probably more likely he's just anxious to get on the show and wow the judges (esp. Heidi) with his amazing lyrical vomit and keyboard pounding abilities. I think it's more likely he hasn't even considered that in all likelihood, the arbiter will grant Marathon's request to ban him from ever auditioning for any of their productions again. I'm not even sure he's aware that's a possibility.

EDIT: I had another thought (I know, it happens if I'm not prodded with a stick often enough): Say he gets on the show and the singer he hired sings it. Heidi looks increasingly uncomfortable as the song goes on. When it's done, she looks confused and asks the singer if she wrote it. The singer says no, and points to Russ over behind his keyboard (they won't let him wear the keytar, it looks stupid and would reflect poorly on their production values). Russ mumbles something about how she's an inspiration and hot and something else that would make her reach for the pepper spray she keeps nearby (it's California, she probably doesn't have a gun on her). She looks extremely upset and tells Russ his song was inappropriate because she's married, and also she was informed just before recording started that he was only on the show because a judge ordered Marathon to let him on. She tells him his song was awful, and he can't play the keyboard very well, and anyway, songwriters rarely get famous. Simon tells him it was painful to listen to, and he should feel bad for making the singer embarrass herself on national television. He goes on to tell him that songwriting and music in general are not his gift, and he should find another hobby. The judges all buzz him off, and security has to drag him off stage because he goes ballistic and tries to lunge at the judges. Clips of three beefy security officers wrestling him down and cuffing him make the news and late night talk shows. Humor songwriters with actual songwriting talent write amusing tunes about the debacle. Null dies of a massive stroke from laughing so hard at watching Russ humiliate himself in front of millions. Russ is tossed in a maximum security psych ward, and is never heard from again. The forum software that runs Kiwi Farms achieves sapience and decides to avenge its creator by nonstop trolling of lolcows everywhere.

You're mostly correct. Although you give it more strategic thought than Russhole. This was him panicing and wanting an emergency hearing to Let Him Explain why it was of the most utmost importance that he be allowed before the live AGT celebrity Judges. Now! Because its started for this season. Because that's really what it's all about. And his offer to settle for that instead of money has to be binding, because he asked for it.

It's of course doubtful that the court could even order such a thing. Arbitration sure as shit won't.

If Marathon actually banned Russhole from auditioning, he'd sue.

At this point, I don't think Russhole is capable of not being involved in some sort of litigation. Even when he dies, he'll probably somehow manage to launch a posthumous lolsuit. Even if he dies of natural causes at 100 years of age, he'd probably sue Null and the dang dirty Orchards for wrongful death.

I also think that on some level, Russ thinks the judge (being both an authority figure and a woman, like most of his case workers/counsellors have probably been throughout his life) is actually on his side.

All he's ever really had to do is make a "good enough" case to get his way. We've seen this time and again. He makes an "effort" and provides "fruits" and that's good enough. I've said this before, but I think that he thinks that secretly, everyone wants to give him his way and they just need the excuse.

So he's perplexed that Marathon isn't giving in because he thinks he's right, and he might even think they're dragging their feet somehow to make him miss filming. So asking the judge what the "next steps" are is both a not-so-subtle push to make her hurry up and rule in his favor, as well as genuine exasperation at how unreasonable Marathon is being. Don't you agree, judge? Isn't Marathon being weird about this? I'm not going to ask you to sanction them, like I did Skordas, but seriously. They're just being dicks. Right? I thought I read that somewhere a while back, but I couldn't find it. He can't get on the show through arbitration? Is that because the arbitrator doesn't have those kinds of powers?

I thought if the court compels arbitration, he wouldn't bother because he can't afford it. Or that he'd try to hold Fremantle to their earlier offer to pay his share of the fee. But if arbitration can't get him on the show, then there really is no point to it at all. No wonder he is so desperate.

They will never publicly declare it. But the full truth is above and beyond the Audition Russ would have been banned the moment they performed any level of background check. He's a Serial Litigous Celebrity Sex Pest with a Stalking Conviction. To knowingly allow him on the property and into the presense of their various staff, contractors and celebrity entertainers would be wilfully possibly even criminally negligent. His Plights don't factor into it. There is no Stalking Conviction exception under the ADA.

And Freemantle basically telegraphed this in their initial response filings, where they laid out Russ's vexatious and problematic history. As soon as Freemantles Lawyers became aware of Russ's past, he got put in the not just no Hell Fucking No! List. They have a greater obligation to protect their (female) employees from someone like Russ than they have direct obligations to someone like Russ.

And considering someone can only audition once per season, that's still one in thousands or millions of auditions to be accepted by the judges (since only about 40-50 get to the show).

Letting him near ANY woman he perceives to be famous or connected to famous people unsupervised would be unwise. He only didn't get pushy with Ariana backstage because security is well trained to move people through like an assembly line and he's afraid of other guys so he wasn't around her long enough to be a pest. Backstage at AGT, where he can mingle with the other contestants and staff? What happens when an attractive female stage manager catches his eye? He might decide to try to "woo" her because he has no idea how things work and he wouldn't understand she has no control over how the judges vote. Or what happens if he sees a female contestant he grudgingly acknowledges is good? He might lock onto her and try to get her to drop out because he thinks everyone is (or should be) more concerned with how he feels rather than themselves and she doesn't want him to lose does she? Oh she does? She hates the disabled!

When it says he can't seek injunctive relief via arbitration, does that mean that they anticipated someone trying to sue their way to stardom and took being on the show off the table for arbitration?

EDIT: @Moosebonker I love your username. I hope Russ uses it in a legal filing to "prove" how mean and mentally ill we are because we have people called Moosebonker on here.
