In Portland, they're purposely getting rid of car lanes and narrowing bridges to make driving less convenient, and then adding in bike lanes that basically no one uses even in the 100 or so days of the year when it's not raining. It's fantastically stupid.
See also: Minneapolis. There is a plan to reduce one of the major streets to a single lane of car traffic and to add bike lanes like these.

Interestingly, as some may remember, Minneapolis also had a bridge collapse in 2007 and afterwards, there were lots of studies into bridge infrastructure. Not much has changed in over a decade and 1 in 10 bridges in America are structurally unsound: https://www.npr.org/2017/08/01/540669701/10-years-after-bridge-collapse-america-is-still-crumbling

There are two fundamental problems:
  1. The CRA and the jurisprudence around it codify the claim that there are no meaningful, intrinsic differences in capability or aptitude among different ethnic groups or between the sexes. Examples abound. Differences in black & white IQ, difference in male and female aptitude, the influence of sex hormones on psychological traits and social behaviors, the likelihood of Chinese with family on the mainland to steal company secrets, etc---legally, you have to pretend these aren't real, and you have to achieve results in your business as though what is true is false and what is false is true. To the extent you can't force the correct result, you become legally liable.

  2. There is no clear standard of what does and doesn't constitute discrimination. There are no regulations to follow that make you bulletproof; you just have to make sure you are so aggressively anti-racist and anti-sexist that some black, female judge with a chip on her shoulder is going to be satisfied should an activist lawyer ever sue you. Contrast this with, say, OSHA. OSHA has pretty detailed regulations on what constitutes a safe work environment, and if you're following all of them carefully, and a worker manages to break his arm on the job anyway because he's being a dumbass, you're not going to be hit with OSHA fines, and the worker will probably lose if he sues you. g
Let me give you a somewhat recent example. Merrill Lynch lost a fairly large lawsuit filed against it by its black black brokers. You see, they were paying traders bonuses as a percentage of the profits the traders made, and the black brokers were, on average, less successful than the white traders. Now, there's a fair amount of literature showing that the success of of a trader correlates to IQ. Of course, you can't cite that. Doing so would just prove you're a racist. So, the court ruled that granting bonuses as a percentage of profits is racist, because clearly, the only reasonable explanation for whites doing better than blacks at recognizing market patterns is the white traders have advantageous social backgrounds due to the constant racism and discrimination blacks face in their daily lives, thus making it more difficult for black traders to get the news and information they would need to be competitive with white traders. By making bonuses a raw percentage of profits, and not providing any means for the black traders to overcome their supposed social disadvantage, the court found that Merrill Lynch did a heckin' racism. They paid a $160m settlement to 1200 brokers.

That's how it works. It won't change via a state EO. It won't change via being clever online. It can only change by changing the law, and conservatives won't touch the CRA.

Awesome info, thanks. I don't think state EOs will do anything except try out a legal frame that could trickle into legislation in some distant future. Though I'm sure you're right that there's no good way to pitch "fixing the CRA" as a good thing to most people.

I'll be really curious to see how the legal reps argue against affirmative action at SCOTUS. That's only a small piece of the puzzle, but I'd say it set the standard for how far we allow diversity/discrimination concerns to infringe on, say, free association. If the justices even just tinker with it, that would be a signal of where the limits are.

Legislatively, you would have to ban the disparate impact standard. There is a very good law review article here with the self-explanatory title, "Title VII Disparate Impact Liability Makes Almost Everything Presumptively Illegal." This would require a monumental shift in American opinion, since most people believe everyone is fundamentally equal. Anyone who's been a teacher (and isn't some psychotic troon or whatever) can tell you just how deeply that assumption is built into American policy & culture. You would also need to require the EEOC to write regulations defining what is and isn't discrimination. A legal regime where the regulations are bullshit, but at least I know what they are, is preferable to a legal regime where the bullshit is Calvinball.

There are racial and gender disparities in everything. Think of a thing that is characteristic of human beings. Literally any single thing. Who drinks the most water? How does caffeine affect people? Who responds the most effectively to various cancer treatments? Who sweats the most? Who metabolizes sucrose the best? Who has the fastest eye-hand reactions? Who listens to the most music? If we have statistics, and those statistics are disaggregated by race and sex, you will find disparities. A recent example is that a men's tailor found that for online orders, they could get you the best fit if, in addition to the usual measurements (waist size, inseam, etc), they asked for race. You see, the overall shape of a man's body varies by race. And yes, black men need a little more space in the rear of their trousers, and Asian men don't need much at all. But asking for this information, and cutting trousers to fit, is legally risky due to Title VII.

It becomes even riskier when you realize that black men's trousers use more fabric than Asian men's trousers, so if you were to charge people based on the cost of materials, you would introduce a racial disparity in fees, which would be illegal. So in order to avoid fines, at minimum, you need to offload the cost of doing business with black people onto Asians. Which introduces more risk. You need to figure out, ahead of time, what business strategy will make a judge happy, not what actually delivers products to customers that they want and maintains profitability.

This is being done deliberately. As you stated they want to take away easier access into the cities so that traffic times will be increased making it more stressful to commute by yourself.

The desired goal is to nudge / engineer human behavior so that people will prefer to live in large apartment blocks of mixed income persons. Such, you not only own nothing but your association or apartment fees are used to socialize the lower income persons that are more destructive. It's basically a tax increase without being a tax increase.

Furthermore, if you still want to live in the suburbs they want to become reliant on public transport and thereby the state. Concerned about crime on the train?

Well, guns are banned so you will have to pay more taxes for them social programs and the cops. They pension system is imploding? Well, the transit workers are striking so you better agree to higher taxes to fund their pension more.
 
Feelin' pretty confident in my assumption that the coof will be wrapped up in the next month or two.

Of course I see people thinking that will save the Dems, that people will "get comfortable" again, but I have doubts on that as well.

It really seems like they'll be forced to yield - not only is losing the people who refuse causing a nightmare in staffing issues already, but this will also throw a huge chilling effect over future recruiting. They already were having issues with manpower before the coof across the healthcare sector, this isn't helping. And short of Conscription orders, there's no amount of legislature and mandates that will give you more staff.
 
With how quickly the UK reversed course I do wonder if something like this is in play. It does only take a couple of hard nose AG to really make it hurt.

I truly, truly want to see a massive Trucker boycott of Ottawa. Like no professional big rig delivers anything within 50 miles of the city center.
Trudeau doubled down in his speech and pissed everyone off. Farmers and construction workers are joining up with the truckers. His own sniper escort defected and is leading the security team for the truckers. This isn't going away. He was also dumb enough to have a personal staffer attempt to literally false flag. They have enough money and supply's to last 2-4 years and its costing a rough million for the police to monitor them every day.

This isn't artificial, this is legit and establishment was not prepared. I mean who the hell expects the Canadians of all people to rebel?


I have to wonder how the Biden admin is reacting. Trudeau low key confirmed in the speech, that he requested Biden to copy his mandate system. This could have a serious domino affect in a multitude of ways.
