Looks like the judge has scheduled the hearing for mid-August so doesn't really care about whether these morons get to depose an out of state party before that, considering even if he denied the motion to quash that BS, there will inevitably be another hearing in Minnesota.

I'll kind of agree with the point that this dragging on doesn't help Vic (even if it hurts MoRon et al worse), and that it would be better to get a verdict or a settlement with full retractions and apologies sooner rather than later.

That said, let's say Vic is persona non grata at Funimation, even after he wins. Vic still has quite a bit of history and networking in LA, and Sentai might want to poach Vic from Funimation. Monica and Jamie are almost exclusively Funimation contractors, with some work over at Sentai (where they did exclusively voice work, whereas they also wrote/directed at Funi).

I don't think anyone expected the Broly movie to blow up like it did. As of right now Broly isn't a recurring character and the English dub is so far behind that it's almost a non-entity these days. Even after FUNimation and cockdentures dropped Vic he still finished out his other dubbing roles for other studios, I'd wager a good chunk of other dubbing companies are waiting to see what becomes of this lawsuit before writing Vic off.

The dubbing scene isn't going to pass Vic by, from what we've seen the only thing that has changed over the course of 35+ years is the quality of the scripts (arguable when it comes to shit Marchi writes) and audio. It's still the same circus show it's always been with unprofessional tards coming and going.

That's actually an interesting procedural issue. Does it stop all discovery? Does it stop only discovery performed by the party against whom it's filed and the one who filed it? Or is it more flexible than that?

And does the exception apply strictly to discovery related to the TCPA itself? And if so, can the stay exception apply to a party who is seeking discovery despite having no pending TCPA motion of their own?

And even if it is somehow related to the discovery, how much discovery is enough? How much discovery is too much?

Part of the whole point of the TCPA is to protect parties from having to undergo the burden and expense of frivolous litigation, but discovery is a lot of that expense, and that's why the TCPA even has an immediate stay provision.

The law hasn't answered all these questions adequately, which means these parties may be responsible for generously helping it out with any precedents that end up set about them in this case. Oh joy, for everyone involved.

If Judge Chupp were to set precedent on any of these issues, would those decisions be eligible for appeal before the suit is allowed to proceed? Just how "granular" is the TCPA appeals process and how likely is it to hold up the suit for an extended period of time? I know the TCPA is supposed to be filed within 60 days, so are appeals equally time sensitive on how quickly they're heard or acted on?
