I said this in the old thread and I'll say it here. This is a case that heavily favors Jersh.
Claiming copyright on a tweet/skeet? Settled law, Elliot won't win on that one for sure.
Claiming copyright on a non-commercial image used as a head-shot on his "public profiles". Long shot at best. The posts in the thread are obviously criticism and critique of said image and the ones posted are pretty much a slam dunk for fair use as they all "improved" the image via text or adding the posters own artwork. And as much as Elliot hates it, calling someone an ugly, blocked headed, squared jawed excuse of a male is still protected speech. You are allowed to insult people, your allowed to call them names and make fun of them. It's all protected as much as that chaps the decayed skin of Elliot's pimply ass.
And a decent judge will order the DMCA subpoenas held until the issue of copyright is settled in Jersh's lawsuit, which I'm sure Hardin will ask for ASAP. As why litigate twice if the image is found to be fair use them all Elliot's subpoenas die there and then. The troon lawyer obviously hopes the court clerk will just OK the subpoenas as routine so Elliot can get his grubby little paws on whatever data Jersh has so he can try to track down any personal details to use in his ongoing harassment campaign against anyone related to the Farms.
Jersh has a solid case for Elliot's illicit use of the DMCA, we have Elliot's on posts on BlandSky bragging about his actions. That's all admissible. We have a long, documented, history of Elliot doing everything he can to tortuously interfere with Jersh's business. Again Elliot's own posts will easily show this.
Jersh can easily find several people who can testily that Elliot used any method he could to get them fired or ruined professionally and we again have posts from those associated with Elliot's Tall Potty org bragging about it.
My personal opinion is that Elliot is nothing more then a money bag for these Troon Lawyers. I would believe that Elliot is bankrolling the JT Smash case, as the troons want to try to set a precedent that you can hold a single individual responsible for a "hate and harassment campaign". By arguing the JT is personally responsible for everything said online against the whore Mercante you can then start a case that Jersh is also responsible for everything said about well...everyone on the Farms. Section 230 shields Jersh so Elliot's and his troon law firm are looking for a way around that so they can start a who new kind of tort they're calling a stochastic terrorism tort.
I think Elliot's just the fool in this game. It's the troon law firm that's using him to bankroll a whole new industry for themselves. And if it fails, and it probably will as Free Speech is a powerful guarantee in the US (unlike the countries Elliot loves to frequent) well, at least the troons got paid. It's Elliot that will be out the funds so no skin off their frankenstiened vaginas. Win win for them right either way.
Now I want to end with: This all relies on a fair and impartial judge. This case is in Jew York so there is a not insignificant chance that the docket lands before some Lefty judge who knows all about the Farms and will happily award Elliot everything he dreams of. The justice system is flawed by it's nature and anything that involves such a deep blue state is even more risky. So hope that Jersh draws an old school judge who actually practices law and not social justice.
