This is anecdotal, but when I was in high school this classmate who lived down the street from me discharged a firearm towards the ground in his backyard just goofing around. We lived on the same street as a school and were part of the school zone. He said because of this his punishment was initially going to be much more severe since basically they hardline any prosecution on crimes within school zones, meaning they push unusually harder for higher/maximum sentencing. Now he got off somewhat easy since he was under 18 and never actually threatened anyone, which I think they went with the option of first degree misdemeanor and a suspended sentence on probation. But he was originally facing a felony like Boogie, which is used in cases where you "created a substantial risk of physical harm to any person, caused serious physical harm to property, caused physical harm to any person, or caused serious physical harm to any person."

But Boogie being an adult, brandishing the firearm to intimidate someone who wasn't an immediate threat, and actually discharging it as well (supposedly in a school zone) makes me think they will stick to the felony route. Now maybe he can get a long suspended sentence with no prison time, but I have low expectations it will be dropped to a misdemeanor. Unless of course he throws tens of thousands of dollars their way and buys his freedom. I know laws apply differently the more money you have.
Maybe I should clarify. It would be easier to say he wasn't trying to hurt his neighbors if he shot into the ground. Not that he still would not have been charged, but that a stray bullet in the air you do not have a target whereas if the ground is the target, minus a ricochet, you could say you were just trying to scare Frank.
 
I agree with your reasons, but you are leaving out the political aspect of the calculation.
Felon2988 has a profile just high enough that a prosecutor can use his fat neck as a stepping stone to get national media attention. Political advancement, appearance fees after the case ect.
I'm not predicting that, but it should be considered.
The "political aspect"? Boogie is best known for portraying a fat spastic retarded neckbeard trailer dweller on the interwebz. Boogie in fact IS a fat spastic retard on the internet. Boogie is already a living wheezing example of "see this kids! Don't be this!". I'm not sure that this salt encrusted 500 lb sack of Krispy Kremes in acres of human skin is a trophy any prosecutor would take pride in bagging. Nor anything worth "making a high profile example of". I'm not saying the prosecutor won't heavily charge and prosecute the fat fuck. I'm just saying I doubt his e-celeb status will have much impact on the calculus. Simply because life itself already holds boogie up as an example to frighten children into not being fat retards.

My point was that his status makes it more likely for a prosecutor to try hammering him as hard as possible so the prosecutor can gain politically.

IMO the law should change the wording "self-defence" to "Immediate-unprovoked- unavoidable defence against lethal danger." So that people really know in which circumstances to discharge a firearm against a fellow human.

The people going about legal finessing for Boogie are high on copium. The state will drill you in the ass if you had even the smallest chance to avoid the problem or if it was escalated in anyway.

Anyone who isn't an absolute idiot pleads not guilty. Why would he plead to the worst possible outcome without even trying to cut a deal? He may be stupid, but he's not that stupid.
 
I have a sneaking suspicion that Boogie is the kind of person who simply cannot be reasoned with, so even if what you have laid out is the most sound strategy for him going forward - will his legal counsel be able to convince him it's the way to go?

My thinking is that Boogie genuinely believes all the nonsense he spews, and for that reason will actually want to get off on this despite the fact that he has committed some crime without a shadow of a doubt.
