the funny thing about Texas V White, which is the postwar decision where they decided secession was illegal is that it couldn’t find justification in the consitution, and so had to cite the articles of confederation.
The decision was also a bit tainted because any other outcome would have meant that the states which made up the former confederacy would have had to assume all the CSA’s debt, which was the actual cause of action in question that lead the court to rule on whether the states had ever actually legally seceded

I've always believed that instead of making up law, the Supreme Court should be able to fasttrack a constitutional amendment process back to Congress. "Okay, this isn't covered by our current constitution, but it should be". Pretty fucking simple to get a no-secession amendment after a civil war, but they still didn't do it.
Got a Prohibition Amendment, though. Maybe clown world has been around longer than we ever suspected.
