I agree. If you fill the vacancy now, it releases some of the pressure from the election. In essence, it forces the Democrats in to a fait accompli with the court. The best they can do is turn it back into 5-4, if Thomas leaves unless they pack it.

But the Democrats don't have to will to do so. Nominate and confirm, once that occurs this falls off from becoming an election issue.
