Trump’s plan to curb teen vaping exempts some flavors - Menthol, tobacco, vapecel tears only flavors to be allowed

WASHINGTON (AP) — U.S. health officials will ban most flavored e-cigarettes popular with underage teenagers, but with major exceptions that benefit vaping manufacturers, retailers and adults who use the nicotine-emitting devices.

The Trump administration announced Thursday that it will prohibit fruit, candy, mint and dessert flavors from small, cartridge-based e-cigarettes that are popular with high school students. But menthol and tobacco-flavored e-cigarettes will be allowed to remain on the market.

The flavor ban will also entirely exempt large, tank-based vaping devices, which are primarily sold in vape shops that cater to adult smokers.

Together, the two exemptions represent a significant retreat from President Donald Trump’s original plan announced four months ago, which would have banned all vaping flavors — including menthol — from all types of e-cigarettes. The new policy will preserve a significant portion of the multibillion-dollar vaping market. And the changes are likely to please both the largest e-cigarette manufacturer, Juul Labs, and thousands of vape shop owners who sell the tank-based systems, which allow users to mix customized flavors.

E-cigarettes are battery-powered devices that typically heat a flavored nicotine solution into an inhalable aerosol. They have been pitched to adults as a less-harmful alternative to traditional cigarettes, but there is limited data on their ability to help smokers quit.

The Food and Drug Administration has struggled for years to find the appropriate approach to regulating vaping. Under current law, all e-cigarettes are supposed to undergo an FDA review beginning in May. Only those that can demonstrate a benefit for U.S. public health will be permitted to stay on the market.

“We have to protect our families,” Trump told reporters on Tuesday, ahead of the announcement. “At the same time, it’s a big industry. We want to protect the industry.”

The flavor ban applies to e-cigarettes that use pre-filled nicotine cartridges mainly sold at gas stations and convenience stores. Juul is the biggest player in that market, but it previously pulled all of its flavors except menthol and tobacco after coming under intense political scrutiny. Many smaller manufacturers continue to sell sweet, fruity flavors like “grape slushie,” “strawberry cotton candy” and “sea salt blueberry.”

The flavor restrictions won’t affect the larger specialty devices sold at vape shops, which typically don’t admit customers under 21. These tank-based systems allow users to fill the device with the flavor of their choice. Sales of these devices represent an estimated 40% of the U.S. vaping business, with sales across some 15,000 to 19,000 shops.

Still, the new policy represents the federal government’s biggest step yet to combat a surge in teen vaping that officials fear is hooking a generation of young people on nicotine. In the latest government survey, more than 1 in 4 high school students reported using e-cigarettes in the previous month, despite federal law banning sales to those under 18. Late last month Trump signed a law raising the minimum age to purchase all tobacco and vaping products from 18 to 21 nationwide.

“We will not stand idly by as this crisis among America’s youth grows and evolves, and we will continue monitoring the situation and take further actions as necessary,” Health and Human Services Secretary Alex Azar said in a statement. Companies that don’t stop making and distributing the restricted products within 30 days risk penalties by the FDA, including fines and seizures.

Incoming FDA Commissioner Stephen Hahn said the government’s approach attempts to balance the problem of underage vaping with “the potential role that e-cigarettes may play in helping adult smokers transition completely away” from regular cigarettes.

But the decision to permit menthol and exempt tank-based vapes was immediately condemned by anti-tobacco advocates who have lobbied the Trump administration to follow through on its initial pledge to ban all flavors except tobacco.

“Only the elimination of all flavored e-cigarettes can end the worsening youth e-cigarette epidemic and stop e-cigarette companies from luring and addicting kids with flavored products,” said Matthew Myers, of the Campaign for Tobacco-Free Kids, in a statement.

Myers’ group and others have long opposed all flavors in tobacco products, including menthol in traditional cigarettes. They argue that teenagers who vape will simply shift to using menthol if it remains on the market.

When Trump officials first sketched out their plans at a White House event in September they specifically said menthol would be banned. But that effort stalled after vaping proponents and lobbyists pushed back and White House advisers told Trump that a total flavor ban could cost him votes.

Industry groups including the Vapor Technology Association launched an aggressive social media campaign — #IVapeIVote — contending that the plan would force the closure of vaping shops, eliminating jobs and sending users of electronic cigarettes back to traditional smokes.

Trump’s initial announcement came amid an outbreak of unexplained lung illnesses tied to vaping. But since then health officials have tied the vast majority of the cases to a contaminating filler added to illicit THC vaping liquids. THC is the chemical in marijuana that makes users feel high. Makers of legal nicotine-based vaping products have tried to distance themselves from the problem.

Trump suggested ahead of the announcement that the flavor restrictions might be temporary.

“Hopefully, if everything’s safe, they’re going to be going very quickly back onto the market,” he told reporters at his Mar-a-Lago resort in Florida.
 
I hate vaping and think anyone that does it deserves to be mocked, but I fucking hate authoritarians and their bootlickers even more. Just because you have a hate boner for something doesn't give you the right to tell others they can't partake of it either. That's what leftists do, and friends don't let friends act like leftists.
 
I would not be surprised if Barron had gotten a hold of a Juul or some shit. Any whore most of the recent health scares are because these assholes decide to put mary-jane products in their vapes that had vitamin E acetate. This whole nonsense of banning shit doesn't fix anything. Raising the age won't fix shit either. All you can do is educate your kids and hope they aren't so exceptional that they heed your advice. 18 is the recognized age of being an adult, so I would say if you are old enough to fight in a war/vote you are old enough to irrevocably fuck up your body with vices.

I don't get why this is such a moral panic all of a sudden. Vaping is not as dangerous as smoking (unless you're being retarded like mixing shit, "cloudchasing", or vaping weed in a vape meant for tobacco) and is already regulated under the same shit tobacco is.

And why isn't menthol banned? Is it the Congressional Black Caucus demanding menthol still be allowed just like Obama came down on flavored cigarettes? I'm glad Trump wants to make sure blacks can still vape their menthols.
That's probably just because the politicians aren't getting enough tax revenue from tobacco products anyway, the only people I see smoke actual cigarettes are usually aging boomers already too addicted to quit.

The harm comes from the heated gases inhaled into the lungs which leaves the lungs open to tar and the garbage contained in vaping. It's not as dangerous as smoking a cigarette but it still does contain carcinogens.

I absolutely agree. This bullshit started with the drinking age being raised to 21 thanks to MADD. Maybe being considered a legal adult should be raised to 21 if we keep this shit up.
 
I'm not a smoker, but I work in a gas station, and this is just stupid. We have an entire skittles rainbow of swishers on display for baby's first blunt wrap. So you can't vape grape, but you can suck it down in cigar form? I wasn't really against them raising the smoking age to 21, though I think they should have rolled it in like they did back when it first went up for drinking. Those poor addicted 20 year olds... But I've seen just how exceptional 18 year olds can be. Maybe 100 years ago 18 year olds were like adults, but they sure as fuck aren't that way anymore.

But if an adult wants a peach flavored Juul then the government should butt out! If we can sell 14% Four Loco tall boys that taste like rainbows and drain cleaner to the alcoholics, then why are you stepping in here.

And pair all this with the mass legalization of weed...the government needs to make up it's damn mind. Are we going to be a nanny state forbidding the vulnerable from gateway access to dangerous and addictive substances, or are we a libertarian utopia of informed consent?

You can say we haven't proven all vape products are safe yet with exhausting studies. You can't credibly claim you know it's as dangerous or more dangerous than traditional smoking because it probably isn't.

And now that flavored vapes are being banned because muh children (it's like I'm living in the fucking 90s again, Jesus Christ), get ready for more health issues as kids and teens add their own aftermarket flavors and make their own vape juice.

And what will be the response? Calls for more regulation. Because people are goddamned stupid.

Not to nitpick but nicotine is very harmful. Its used as a 'natural' pesticide for a reason, it also takes very little to kill a human. People have been using to commit suicide for centuries. Not to mention you'll never seen people picking tobacco by hand in the rain because it causes the nicotine to leech out of the plant in high enough quantities to easily kill workers.

That said, tar is hardly the only dangerous chemical contained in a cigarette, nor is it the only carcinogen by a long shot. Benzine and hydrogen cyanide come to mind just off the top of my head

Well, and the fact that I can get 6 months worth of glycerin and nicotine for like 20 of my local non-freedom pesos, but it's mostly the potential fiery death.

I couldn't get into vaping but I'll use on! or Velo at work since I can't hock loogies on the floor, I just put them in a nondescript container and tell the boss they're mints.

I tried the whole vape thing but that's what happened to me too. I was expelling mucus like a Nurgle worshipper. I returned to my trusty old pipe soon after.

I get it as a glycerin solution from some online vape shop in Toronto. dashvapes or summat. They sell salts too but I find the solution easier to mix.

It's pretty easy to acquire and mix flavors, but getting them into the shitty little pod devices (which are what's being restricted here, tank & mod type devices are exempt) is another story. Wouldn't be surprised if some idiot tried, failed, and ended up hurting or killing himself though.
 
for people that say to just use cigarettes. Vaping is bare minimum 95% safer meaning you get the nic without the cancer. It tastes way way way way better. It doesnt degrade your car value by leaving a smell. It doesnt degrade your house value. There is no second hand cancer that lingers around. If you have kids it isnt harmful to them like cigarette smoke. Vaping is not near as addictive as cigarettes. Cigarettes are only addictive because of the 7 billion chemicals in them. etc. etc. cigarettes shouldnt exist and vaping is making that a reality. This also means the states are flipping shit due to lost tax money.

This isnt about public health at all. It is about keeping tax revenue up. If that means keeping people on cancer packs then so be it.
