Yes. The answer to both of those questions is yes.
Part of it is that but a big part of it is that our prisons are all stuffed to overflowing. Most prisons don't even have enough cells for the rapists and murderers let alone people convicted of assault and lesser violent crimes.

Compounding this issue is that most states have zoning laws that forbid new prisons from being built basically anywhere.
I feel like we could find some kind of very poor State and pay them a ton of money to create some kind of super prison.
Maybe one in the Mojave desert, that way if anyone escapes they will die from the harsh climate before they get to freedom.

I just got approached by a recruiter for a very established company offering an interview for what could be the biggest paycheck of my life. The downside? I’d have to move to the Seattle area. I’ve never even been to Washington and everything I have ever heard about Seattle sounds like hell. But I’m also a life long southern Californian.

What’s your take? Should I just pass? I’ve been trying to escape this state, but CA to WA just seems a lateral move

That may be too low to live a middle class lifestyle in the Seattle area. 50 year old track houses go for seven figures and there's a lot taxes such as a 10.55% sales tax and 0.9% property tax.

You'll also want private schools if you have kids. Schools and NGO's are actively transing kids and state law protects them from parents. Some parents have even lost their kids to trans NGO "shelters" and there's nothing they could do about it. Beware of any programs or activities involving "skittles".

It won’t go to SCOTUS. This is a state issue. Different states give sheriffs different degrees of power.

That's why I think we should bring back the stockades for lesser crimes. It would alleviate overcrowding while sending the message you can't just get away with shit.

Municipal politics can be weird, especially for smaller communities. The good old boys running it probably focused enough on housing and boomer issues to keep getting themselves re-elected.

It's a difficult issue because you are quite literally arguing against case law and stare decisis for the 8th amendment of the US constitution, specifically "cruel and unusual punishment".

But it really isn't being followed either, not in the spirit of the law,

In many jurisdictions, there isn't bail anymore. And as if to be smart-asses, local jurisdictions will institute "minimum bail" and then set the bail to $1. "Cashless bail" is like saying "invisible wall". It is a contradiction. Bail is insurance paid to the government in case past is prologue and you do cause more destruction. Onto fines, I would argue legal fees, court fees and the interruption to your daily life fall under "fines", considering the phrase "the process is the punishment" has been a saying for many, many decades. And "cruel and unusual" has been stretched so much out of proportion that we simply don't punish criminals anymore, with case after case of some guy literally shooting someone and just walking free the very same day because of the aforementioned cashless "bail".

So now it reads more like,

Eighth Amendment said:
Excessive bail shall not be required, nor excessive "fines"* imposed, nor cruel and unusual punishments inflicted.

No harm in doing the interview. And I’m sure in Seattle there are places that are not shitholes, you also don’t necessarily have to live in the city

8th Amendment jurisprudence is all over the place. It's full of rulings that have reasoning as brain-dead as Roe and Wickard and could pretty easily all be swept away by a conservative court with a commitment to originalism.
