I think Nick just sees everything like a court battle to win with magic words. Actual logical consistency and morals mean nothing, all that matters is his words beat your words.

In one case he'll argue that Melton's repeated pattern of sexualizing minors is fine because he's just joking and shouldn't be taken seriously. In another he'll argue that Kurt inviting girls of the age of consent (which includes underage girls) to his house for pizza casserole is abhorrent.
