This is correct to my knowledge. This was Metallica's defense when people called them out for being so litigious back in the day. If you don't actively pursue protecting your works then you have a much weaker case (which would be weakened further by Phail saying that he doesn't want those people watching his content anyway and he's glad they're watching the market substitute). I'm not sure how it works with content and videos but I assume the same general principles apply.If I remember correctly if you think someone is violating your "copyright" you HAVE to sue them to show you tried something. Because if not wouldn't the judicial system laugh it out of court because YOU, YES YOU did not do your due dilitgence?
As with anything Phail assumes that opportunities available now will always be available. Let's be real, he's never suing anyone, but even if he wanted to at this point there's no shot he'd have a case. Still, if he wasn't such a spineless faggot he would claim Raw but he'll never do it. He needs Asmon to do it for him.
