Miami man awakens to burglar touching his penis, urinating on him, police say

MIAMI — A Miami man is facing multiple criminal charges for a bizarre burglary over the weekend in the city’s Flagami neighborhood, according to police.
Investigators said it happened just before 4 a.m. on Sunday.
According to an arrest report, the victim called police to his apartment in the 4200 block of Northwest 11th Street and told officers that he had gone to bed after accompanying his friends to the parking lot and forgot whether he had locked the door.
Police said the man told them he “woke up” to a suspect, later identified as Maykel Rodriguez Jr., “on top of me and touching my penis over my clothing.”
The report states that the victim told officers that Rodriguez, 34, then “proceeded to expose his penis and urinate on me before leaving the room.”
According to the report, the victim told officers that as Rodriguez grabbed his clothes and left, he told the victim, “I know you.”
Authorities said the victim was able to provide a description of Rodriguez and officers were able to locate him at Northwest 43rd Avenue and 11th Street. According to the report, Rodriguez lives a few blocks away from the victim’s apartment.
They said the victim was able to “positively identify” Rodriguez and the latter “refused to speak or answer any questions” before officers arrested him on charges of burglary of an occupied dwelling, battery and indecent exposure.
In court on Monday morning, Rodriguez’s attorney, Peter Heller, asked for his client, who he said served in the U.S. Air Force for five years, to be given a bond.
Prosecutors asked for a pre-trial detention motion without bond pending a hearing.
“The facts are pretty egregious,” prosecutor Nessa Eth said. “He’s breaking into someone’s room at four in the morning, molesting him, urinating on him.”
Finding probable cause for an upgraded charge of burglary with assault or battery, Judge Mindy Glazer said, “There may be more to the story,” but granted prosecutors’ request.
If found guilty of burglary with assault or battery, Rodriguez could get a life sentence, Glazer said.
Glazer said Rodriguez is scheduled to appear before Miami-Dade Judge Tanya Brinkley for a hearing on Tuesday morning.
