My gut says no. Judgments from lower courts get invalidated all the time (at least in the EU), I would definitely not take this chance when you can't appeal. There is a reason these judges are where they are.
 
This jeet isn't poor enough to claim IFP is he? So if you force him to federal you *could* punish him with the process but potentially end up in a fucktarded lawsuit Like greer's or roll the slots in Judge Judy's court.

Either way you should demand it to be streamed to court tv and we could potentially fuck up copyright some more if the judge insists on being retarded.
 
"Boards" and "Commissions" and "Tribunals" are routinely abused by vexatious litigants as a way to end-run-around the requirements of ordinary civil procedure and avoid their costs while still causing a hassle for the defendant. Look at Jonathan Yaniv's endless abuse of Canada's Human Rights Tribunals. It costs him next to nothing to file complaints, and defendants still have to burn lots of cash to defend themselves. They don't have to, but that means they'll likely lose.

Don't let Roy off the hook here. Make him litigate properly. For one thing I doubt the faggot can afford it (he wouldn't have tried hassling you for SIX YEARS by email if he could afford to litigate -- he'd have just fucking done it), and for another I assume submitting to one of these ridiculous "tribunals" means surrendering a bunch of rights yourself. He's trying to avoid a real venue because he knows his claim is bullshit.

Between that and not knowing the first thing about this potential kangaroo court, I'd strongly recommend refusing to participate there.

Maybe the best option is federal, but honestly I have no real advice to offer. Does Hardin know anyone that's used this newfangled board?

There are situations in which I think the CCB could be useful or even desirable.

Roy is a broke enough moron, however, that I think that making him go Real Deal court is the move. And yes, I know how much Russ is abusing the process right now.

I will clarify in OP that basically we have no idea what happens in Judge Judy's court. It might be possible the Judges are actually all very excellent and sympathetic to fair use and might just immediately handwaive away this bullshit.
which would be cheaper? the expenses and potential 5 years on another federal lolsuit or the capped outcome from the judge judy court? if judge judy is cheaper, it may be worth testing out the waters.

greer had a copyright group help him win his bullshit appeal. it wouldnt surprise me that there will be other groups or the same group helping this shmuck win one for copyright (and censorship)
 
Forcing this retard to bother federal courts with this frivolous lawsuit would be a lot funnier, so I vote for that.
 
So the question is: Do we invoke our Constitutional Rights to not submit ourselves to Judge Judy's court and demand Roy Philopose sue us in Federal Court (which he might), or do we play in Judge Judy's court and see what happens? The CCB is so new we don't really know what happens in it. Playing in the CCB means we greatly reduce our liabilities and reduce our expense in litigation (I can answer it myself!), but because it's so rare anyone even uses it we don't have a clue if the process is very unfairly slanted in favor of complainants.
Insofar as you now have a viable source of income to offset potential losses I'd say using the CCB is probably the way to go: Even if you lose, you don't lose... whereas if you demand he file in federal court then even if you win you lose. If you choose the CCB route I would recommend compiling a list of publications from news outlets that commented on his antics to illustrate public interest and make it clear that this lawsuit was filed frivolously and vexatiously against someone he felt would simply cave and give him easy money (as opposed to a major news outlet who'd laugh, tell him to pound cow patties, and has an army of schysters to make that stick). Be polite, firm, concise, and accurate. If you can do that then you can win on the cheap. If you can't resist being a fucking retard for five minutes, well, then ask Hardin to either draft a filing for you or edit a filing on your behalf to make it less spergy.

TL;DR Go with CCB, and have Hardin draft your initial filing if you can't resist being a retard long enough to do a proper response.
