I guess this proves once again that people like LJF do what seems like the most politically opportune thing is at any given moment. What a shocker that is!

Someone should probably sit down and read through the whole PDF first. I see references to mitigating civil liberty concerns, like allowing people a choice to delete their data rather than submit to inspection.
It seems like to me it's recommending actions for ICE and CBP to avoid getting their evidence thrown out for being obtained illegally. By leftist logic, he is absolutely complicit in the "crimes" those agencies have committed against spics.

Under the exclusionary rule, evidence wrongfully obtained must be excluded from trial unless it falls into an exception of some sort. This paper essentially wrestles with the question of whether the Fourth Amendment exception to searches/seizures relating to border enforcement (usually geographically connected to an international border) applies to devices. Closer to the time of this paper, there were a lot of questions about the degree to which police could search a device without a warrant specifically authorizing that search. The paper is discussing how to use the border exception to apply to devices and thereby allow the evidence gathered from those devices to be used in court proceedings. It's pretty much what I would expect tech policy people with zero legal training to come up with—it ain't law review material.

Of course, it doesn't address at all questions of the Fifth Amendment (compelled self incrimination by forcing someone to open a locked phone) or Fourth Amendment standing issues (only the owner of the device has standing to enforce the exclusionary rule, so evidence of illegal family members or their activities would still be usable against those third parties). Those are the more interesting questions, from a legal viewpoint. So if LFJ gets fucked with because of this paper, it won't even be a result of creating something useful for Trump-era border enforcement.

Until the day Elliot is removed from any position of influence, covered in so much mud he can't get clean, and reduced to coping, seething, and dilating on BlueSky (or whatever the new tranny hangout is), the war continues. I will, however, consneed concede that we won some important battles and made Elliot look like a complete fool. It's not Total Kiwi Victory, but it is a victory.

Liz Fong Jones is not only a fan of consent accidents but also has a history of working with Immigration and Customs Enforcement (ICE) to help them better search thinkpads that they seize when arresting mexicans for making non-compliant tortillas - Gamers, I can't remember, but is working with ICE something that is looked upon positively in the transgender community?

Weird, I guess he helped write that in 2013. Then in 2020, a group of communists tried to make GitHub cancel their contracts with ICE by vaguely threatening a boycott, and Dong Gone co-signed the demand letter.

I don't really blame the fact that he's a freakish Chinese eunuch as much as the fact that it's tech policy people. They always think they're very smart and can direct how the world works. But when you actually get into an area like law, which has its own idiosyncratic norms and a whole ocean of knowledge fairly inaccessible and unknown to the general population, the incapacity of the tech guys becomes obvious. I assume this is passing material for an engineering program—or even a policy program—but it's failing work for the legal world. It doesn't demonstrate even any attempt to engage with ongoing developments in the courts or the application of existing law (that couldn't be found through a google search and a CRS report). It's certainly not getting cited in DHS memoranda or the OLC. That's not because LFJ cut his balls off, it's because he's an autistic tech guy way out of his league. It's the equivalent of submitting a fifth grader's book report about Hamlet to a college class on Shakespeare as the final paper.
 
He's still listed on amnesty internationals site. Strange for someone who's done work for ICE and rapes people.
And was actively attacking TOR exit nodes - the very technology dissidents living under authoritarian regimes rely on to survive. Not trying to power level but I was an annual supporter of Amnesty International up until last year, and now I'm not.
