There was some talk she might have been in delirium from sepsis.
She'd be in the hospital if she had something as serious as sepsis or medical delirium. Hospital trespass bans don't cover true medical emergencies. But the hospital cleared her for both a ban and toss-out, and for jail medical clearance.
She's definitely mentally ill. But at the time of the arrest she wasn't so crazy she was an immediate danger to herself. That's the standard for committing someone in most states (outside jail). Unfortunately, you can think the CIA put radios in your teeth and still be considered sane enough to wander the streets. That's why we've got infinity psycho homeless people downtown.
She also was logical and coherent enough to run through her list of resources. As the nurse said, she knew exactly what she was doing. She made a bunch of arguments to the cops for why they can't throw her out, refuse her a ride somewhere, make her walk, arrest her, etc. Bad arguments, but still following a logical chain of argument.
But she's probably too crazy to assist in her defense. She probably just ranted at her public defender and filed false rape reports against the entire jail staff.
That's where the jail system will transfer her to the nuthouse unit and why the courts will make sure she gets a mental evaluation. She's going to stay in jail until she can either understand court and make informed decisions about her case, or until the court decides she's always going to be too crazy to work with a defense attorney.
You can't put someone on trial if they can't understand what a jury is, or can't stop screaming the judge buttfucked them.
