That's fkn crazy, I seen this video, but I had it on silent W closed caption & was trying to think who the Josh was he was talking about & I thought it must have been someone who had made a video saying he was sick at some point & this was his dad confirming the son passed & bc I couldn't think of who it was, I just closed the video.

Shit man.My favorite bit of obscure cobes lore is that Gerad Way (of my chemical romance) owned a genuine copy of a cobes record. All because Gerad Way was a fan of really obscure sounding and uncanny music. And through the cobes connection with deathbed tapes, he found cobes and enjoyed it. There is nothing more goth than king of the 2000s mall goths listening to your shit cause it soooo bad its goooood.

I'd say it's at very least negligent, but probably rises to a higher level such as grossly or criminally negligent. I don't see a non-criminal state of mind where you're trying to trick kids into playing in traffic. I've generally seen the usual proximate cause reasoning get extremely broad when injury results from intentional conduct intended to cause that specific harm while also being extremely likely to cause it.The general duty owed is that of reasonable care. I don't disagree with you, but I don't find you example exactly analogous. Also there's still an argument that the child's own negligence contribute to any harm. They would be held to the standard of a child of similar age and experience. If most kids wouldn't go play in traffic on the advice of a stranger, then doing so is negligent. I know that sounds harsh, but its realistic. I do this shit every day.
Proximate cause is still an issue. You could know someone is an alcoholic and is going to drink alcohol sent to him, but he's also going to spend money you send him on the very same thing. You wouldn't hold someone liable for sending him money just because you knew he was an alcoholic and if you were sending him something legal and then he did something legal with it, drinking it, you may be a monster, but you probably can't be held liable.The burden of proof in civil court is very low. I’d argue they had a duty to leave him alone and not harass him, including sending him the means to kill himself.
