I think he's is missing the part where a game that has already been sold is literally a scarce good. A digital scarce good, but a good nonetheless. This means IP law or not it shouldn't be difficult to prove the game is a property that the customer owns, therefore it is unlawful to pull the plug on a game that has been paid for.
