Nick says this is a criminal case and Hardin was using civil procedure to gain access to the bodycam. It may seem as though Nick actually respects Hardin approach because it's very complicated on what he is trying to achieve. However, Hardin forgot all about Nick's wife and children.


The bodycam "should not have been released because it is still technically confidential because they are a part of an ongoing criminal investigation which will not end until 90 days after his sentencing. "

Nick observes that you can hear the frustration in Hardin as he reads the document. There is a grand conspiracy by the state to protect Nick. Nick says the state has done everything within it's power to destroy all that he has built. He's quick to say that he had a hand in that too. His life, business and relationships are nothing but rubble. He calls Kiwi Farmers retarded if they think his family has paid off the county. Nick denies this of course and claims the Kiwis jump to the next option. Which is, we say that his family bought/bribed the judge and lawyers. How can that be! He doesn't even know how to or how much it would cost bribe someone.


"There was no formality of offer and acceptance because they weren't offered." He continues, that Hardin is using a line of dicta from Abrago Garcia which is not holding the principle he is trying to hold.



"I won't have a felony for me unless I fail probation. Assuming I complete probation, I'll never be convicted of a felony crime." Nick finishes reading the document and confidently says "that's a bad ruling for Josh. That's a really, really bad ruling for Josh." There is no way the bodycam footage was intended for the public to see. It was a mistake by the clerk. The one he thinks might be MNPublicRecords.

Thank you so much for the highlight clips, @Sneed on Cloud 9. Is it just me, or has he started breathing into his microphone excessively? You can constantly hear him huffing into the mic now. I don’t recall him doing that in the past. It’s rather irritating.

I still fail to understand how regular viewers manage to watch him. Beyond the flawed reasoning and poor legal analysis, there’s the grating voice, the odd body language with his eyes darting everywhere, the incessant huffing into the microphone, and his habitual complaining about his own troubles on every stream. Altogether, it makes his show almost unbearable. How does anyone endure watching this regularly?

I’ve only seen like 2-3 people who invoke this kind of nigger rage. Wings of Redemption is one of them, and DSP is another. They refuse to believe they did anything wrong and they will continue to refuse to accept responsibility for their lives. Add onto that, though, the fact that Nick has 5 kids in the mix whose lives are irreparably damaged by his decisions, and it just brings me to a new level of MATI that I didn’t think possible.

Presumably the more interesting aspect would be the conduct that led to a restraining order and whether that constitutes a crime with all the caveats about the standard to which that conduct has to be shown to to get a restraining order being far less than that required for a criminal conviction?

It really is wild to see a former attorney being this smug about an ongoing case. He should know as well as anyone that you never really know the outcome until everything is over.
It's been a theme of his since before "the Fall". The Vic Mignogna coverage was full of it.

To be fair I don't doubt that this approach is popular with viewers. It's a cliche that lawyers love using euphemisms when asked, by the paying client, about the likely outcome of a case. You have a case, you have a good case, it's an arguable case, you have a sporting chance, you have a reasonable case, you should win, you're likely to win &c. And clients hate it because of course it's meaningless and often push for something that at least sounds more precise like a percentage. Of course when the case is lost after the lawyer said there was a 90% chance of success the lawyer is not wrong; that client was just in the unlucky 10%. A wiser man than I once told me that you should always add in a fudge factor of between 10% and 25% for "litigation risk" and there was a time in Britbongistan when the Court of Appeal was regarded by the profession as so unpredictable as to justify a 25% fudge factor even on what should be a dead cert.

With Nick he also freely comments in the same way on his own legal woes. It's accepted wisdom not to comment at all on your own ongoing cases but Nick nose better as he does with so many things. Again it's a longstanding thing with him. He declared inevitable victory with his Cuck/Duck Dynasty mini-saga. When it didn't go as predicted Nick just stopped talking about it and, as far as I saw, got away with that one.

One of the big problems is that when a lawyer (or any other expert in a particular field) says what will happen and it doesn't happen, credibility takes a knock. Specific circumstances may make that unfair but patterns are patterns and life ain't fair. If the lawyer declares with absolute certainty what will happen and it doesn't that just makes the impact on credibility all the greater.
