Yes, to be honest it's the only thing that gives it a shot right now. This motion to correct the record doesn't actually undo the others. the short of it is thus: the weight included containers (baggies) and other drugs that fell under different sentencing guidelines, and sentencing guidelines meant his chances of going to prison (not federal) were slim as this was his first offense

The field testing weight was enough for a second degree felony. But the trial weight ended up being third degree felony. This isn't at all unusual. Its why they always have the lab weight the drugs.

Nick was never facing federal charges and never going to federal prison. Under Minnesota sentencing guidelines he was always going to get about the same sentence which involves lengthy probation. There was no chance on those charges of him ever going to any prison.

And if there were positive evidence in the bodycam footage for Nick, his attorney wouldn't have been in court fighting to block the release of the bodycam footage.
