IIRC, setting tariffs are under the responsibility of Congress, but they delegated special emergency powers to the executive branch so POTUS can change and introduce tariffs quickly in response to sudden economic threats to the US. Trump is using those powers to drastically adjust our tariffs which the judge is ruling that Trump is overstepping his power given to him by Congress dispite Congress not really having that big of a problem with it.
Not only that, it interferes with and weakens America's position in ongoing negotiations; which is the exact thing Rubio was complaining about earlier this week.
So fucking dumb, if this stand and I pray it dosent, it effectively makes our economic foreign policy governed by committee

The gamble (I think) is that the courts are burning their legitimacy in hopes that Trump makes a move against the courts before the larger public gives up on the courts. Then they can say their moves were not only justified, but also point to Trump and call him a dictator more convincingly.

IIRC the courts DO have oversight in the language that handed the tarrif power from congress to Executive, but what's happening here is unprecedented. They didn't nuke all of them, but they nuked the important ones. Unless Trump goes Jackson mode or SCOTUS does something, it's really up to Congress to clarify, since it's their power at the end of it
But Congress works at the speed of Congress. These tarrifs were part of a larger play on the world stage to renegotiate with other countries and there for are pretty time sensitive.
