No that's not really what happened, lawyers chose to specify in certain lawfare and prosecutors and defense attorneys are the two largest differences you can have in your approach to law.
Since he's being sued he needs a defense attorney, which even in his statement he wouldn't say "I hired a defense attorney" because that's usually a bad look. The first set of lawyers he talked to were involved in prosecutorial law, they were the kind to bring suits, not respond to them.

It's very likely his lawyers have no understanding of the total breadth of the situation, and he's leaning on the cyber-harassment clause, showing that intent to harm needs to be proved. He's probably fed his lawyers a similar shit-sandwich as he did to DGG

So what's the probability of the relevant DA(s) opening a criminal investigation into the revenge porn claims? Could any damning evidence found in discovery be used in a criminal case?
