This protects you as the recipient. You having that picture is not illegal.
But if you share it further it is, because you as a recipient who did not personally receive the picture from the person in it, cannot just assume that you have consent.

You cannot reasonably KNOW if you do, so the base assumption has to be that you don't.

Yup, thanks. Also, if you look at the menu on top of the window where you make your post, there's a button next to the smiley face that says "Media" when you mouse over it. If you click that and insert the link, it'll embed it so that you don't have to click the link to watch the video. I'm not sure if it automatically removes the tracker thing, but it's probably better to remove it yourself anyway, just to be sure.

As someone else pointed out, I didn't explain exactly what the statute says, it states:
"the image was obtained or created under circumstances in which the actor knew or reasonably should have known the person depicted had a reasonable expectation of privacy."

The point is the onus is on the state to show that you should have known there was a reasonable expectation of privacy. There is no "base assumption" for anything.
