I agree. I went through the warrant and the probable cause material. The police officer was seeking a warrant on his set of issues based on the total information he had. He was seeking a warrant to search for drugs. The CPS decision to take or not take enforcement action in their particular limited area (child protection) doesn't really matter at all. The police officer is presenting the totality of evidence for a warrant to search for drugs. Its the information that matters for the warrant. Not the enforcement decisions of another agency.

Why does anyone even think this is a viable strategy? If Kayla pleads, she'd have to deliver an allocution of guilt to all the facts that make Nick just as guilty as she is, which can then immediately be used against him, too.
I've been saying he'd do this for months too because it is just the obvious strategy. About the only thing I didn't predict is it would be this absolutely lame, pathetic and incompetent.

One slight possibility could be that Kayla's lawyer has some tactics. The lawyer got her hearing pushed far in future. Get Nick to fight for anything that can and look really bad. The cop watching a reupload of the stream won't matter for the warrant, but the state hasn't subpoenaed Google for an actual copy (the discovery they turned over was the reupload). This is retarded because at trial it would be difficult/impossible to authenticate some random reupload. The state needs someone to testify that it's a true and accurate representation of the original or that it was recorded/stored by some regular procedure. You subpoena a copy from Google for the latter method.
Probable cause was established almost entirely through Aaron's statements and Nick's streams.
The affidavit established Aaron having a close relationship with Nick, including streaming from his house. It contains Aaron's allegations that Nick was on drugs during the cokestream and that he and his kids needed help, which was the day before the warrant issued.

Low key, that’s a nice bit of property there. 7.8 acres of land and you live amidst a bunch of natural lake formations. Plenty of trees. Good school zones. Price is a bit high but I see potential in the bones of the structure. Could easily add another bedroom or two at over 6k sqft living space. Plenty of land to start gardening and farming.
Might need to wash the stains out, though.
