If it was Nick, he would have an abuse charge. If they're charging her for allowing abuse to happen, and we dont see a person being charged, consider that minors have their charges sealed. It's most likely an older kid and a younger kid, rather than Nick, and the charging sounds like he may not have known but she would have.
The way Kayla's charge is written, it sounds like neglect by means of standing by while abuse happens. Someone earlier (good luck finding it) mentioned that maybe the prosecutors want to solidify the charge of actual abuse before formally bringing that charge. Idk if that's actually how that works, but it could make sense that Nick is the active abuser, his harsher charge hasn't been brought up yet, but they're still charging Kayla with complicity.
