The appeal should be successful. Higher courts don't like lower judges saying the Bill of Rights doesn't exist in their courtroom.

And let's put our money where are mouths are. Donate. I did.

She told us, ‘Do not bring the Second Amendment into this courtroom. It doesn’t exist here. So you can’t argue Second Amendment. This is New York.'
How the fuck is a judge actually able to say this? You can't dismiss the damn Bill of Rights like it holds no meaning! I could see a retard in a school debate getting away with making such nonsense statements but for a judge to actually say this and NOT get chastised for it is terrifying.

EDIT: I donated to his legal fund and advise you to do the same.

Always good when they let the mask slip and admit you have no rights in the eyes of the government.

For my own sanity I will pretend this article is AI generated rage bait and didn't actually happen. Blissful ignorance!

God I hope with every cell in my body that this goes all the way to the US supreme court and rules in this guys favor. Gun grabbers and ATF feds seething will be glorious. I wonder what the nationwide consequences for such a ruling would be. Make gunsmithing great again! Hell I'm even tempted to grab the shekels and give the guy some, and I very rarely donate to gofundmes and similar sites.

Is the judge's argument that the 2nd amendment doesn't apply because he was charged under state laws? Can someone who understands laws explain if this is the reasoning, and how it is legally sound or unsound?
It has no legality at all if that’s the reasoning. States fall under the Constitution.

I really don't think it'd be constitional to outlaw homebuilding wholesale. Maybe with restrictions like you have to get it serialized or some gay shit. (actually I think that's the case in MD)
It would be as constitutional as requiring a special license to practice religion, be free from arbitrary search and seizure, or not be a slave.

Not surprisingly, Mr Colion Noir weighs in. Gotta hit close to him. This guy is cut from the same cloth as him for sure.

The way he mocks the judge and gangbangers makes me wonder if this Noir fella is racist...

The US constitution is the law of the land. Every US state cannot make laws that go against the constitution, or federal law. Federal law trumps state law. Of course real life isn't this simple, and there's a bunch of legal mumbo jumbo about the doctrine of preemption I won't go into.

Of course this doesn't stop the states from trying, especially when it comes to trying to weasel in restrictions around guns. A simple example would be a state legalizing weed. Weed is still illegal at the federal level, and you could be arrested by federal agents for marijuana even in a state where it's legal. Now the federal government usually won't do much about the weed issues in legal states because it has bigger problems like making sure you don't post bad things about Jews online, and doesn't feel like raiding dispensaries in Denver. Edit: Feds have raided a few dispensaries before, but they can't/won't enforce this everywhere.

Saying "The 2nd amendment doesn't apply to this courtroom" is like saying "The constitution doesn't apply to this courtroom" and not only has no legal basis, but is illegal.

Poor bastard is still going to spend several years at best in prison.

All because one pissed off jogger judge doesn't like guns. I wish he could sue NY once his conviction gets over turned

Reasoning? From a black woman in power?
Fixed it for you. Any "intelligent" negress activist with a bit of authority and a chip on her shoulder invariably ends up being an insufferable, vindictive cunt, and all semblance of logic and reason go out the window. Kentanji Brown Jackson, Karine Jean-Pierre, Fani Willis, etc. I would say Kamala Harris, but that vapid cunt is so goddamn stupid that she's basically irrelevant.

As far as this case, the best option for the guy is first of all, to obviously appeal and hopefully his legal team has the balls, and the aptitude, to file a complaint for judicial misconduct. Based on the information in the article alone, the "The 2nd amendment doesn't apply here. This is New York City" is grounds for an investigation, IMO. And potentially even more than that with abuse of discretion and others, for not allowing testimony thst would benefit the defendent.
