Lol, this isn't going to blow up in their face at all. All you need is a brave DA willing to take them to the cleaners with obscenity laws. All the evidence presented as part of this suit can be pilfered for the states case. This really is a "Nail that sticks out gets pounded down situation".

BTW this could become a big criminal trial. Any artist, accountant, marketer, and investor has a chance to be not only gaveled up for running this potentially illegal business. But for obscenity charges, which is basically just being a sex offender. Potentially exposing them to decades of invasive probation. The owners may be no strangers to being in the nonce wing. But there probably is a bunch of employees in their warehouse and or clerks filling out spreadsheets in for a rude awakening. Best for many to resign while they still can honestly.

It all could be an entertaining nothing burger. Or it could be a big blow to a major economic pillar of the furry community. What a shame...

I'm almost afraid to ask, but how would one know if a cock belongs to Charizard specifically or some other dragon creature? Does Nintendo or some fanboy keep a chart of how various Pokemon cocks canonically look like?
 
Well they cheaped out going the copyright route, I tend to think design patents would've offered much better protection (well really penetration in this case if you're going for infringement)

Edit - I should add, SinSaint might have been stupid enough to have evidence that will be unveiled during discovery. If that's the case it probably won't progress to that point (if their attorneys are halfway decent).

An imagined animal cock is inherently copyrightable, by virtue of being imagined, but copyrighting the underlying concept is going to be hard to getpull off. So you can claim the exact design of a specific horsedog phallus, but not for every horsedog anyone else might make. If the other work were to copy the horse part exactly, but have a different dog part, you might have a claim, but anything vaguer than that would be quite the Gordian Knot to unravel.

You're thinking of somebody who's on the BD board of directors, one of the higher ups in the company. The average BD worker makes somewhere in the 29K-33K range annually. The company has an opening on their website for a quality control worker and the salary is in that range. The BD company as a whole is no doubt pulling in millions every year both through product sales and all of their investments/properties that either generate income on their own or funnel business back to the main BD site for orders. The people on the BD board live pretty lavishly in the Phoenix, AZ area.

In 2021 Nintendo issued a DMCA takedown to an artist on Patreon who posted a drawing of what they said was Bowser's cock. Bowser himself wasn't in the picture, just his dick, and Nintendo claimed ownership on it. This is kind of a stretch though because clearly this was probably just one of many DMCA notices sent to protect Nintendo's IP in general. I am positive other artists were hit with takedowns that were substantially more applicable. Nintendo's legal team likely just saw "Bowser" and then sent the DMCA without actually looking at what they were serving a notice to. But it's still funny.

I'd think trademark is the closest they could get to actually winning. Altough even that is a fat chance.
