The threshold for establishing "intent" is extremely low to the point of being basically arbitrary...which is why nearly everything is presumptively illegal.

If they didn't find discriminatory intent in Arlington when a member of the city council basically said that nuking a low income housing proposal was meant to keep minorities out of the town, then you can't say everything's presumptively illegal. discriminatory intent is strict scrutiny, which requires a shit ton of proof to justify such a presumptively high level of review.

If I might butt in. It -really- depends on what judge you get. This is one of those issues that sullies the court and you can usually figure out how it will be ruled by just looking up the judge.

obviously, but any ridiculously arbitrary decision is bound to get reversed by an appellate court. I'm not saying the threat if litigation isn't enough to dissuade companies from standing up for themselves, but to suggest that the standards of review are low is absolutely retarded.

You'd think so, you'd really think so, but keep in mind until fairly recently there was a very strong left-lean among the appellate courts. The Trump appointees have balanced that out, but there are a lot of judges in place right now who were put in place based on how much they toed the party line.

I've seen the cases even back in the 70s when the courts were at their most liberal, and even then it was pretty hard to win a discrimination case. Title Vii is somewhat easier, especially when you're dealing with smaller companies, but its still hard. This isn't to say it's impossible to win a discrimination lawsuit, but its not as easy as people think.

When they were most -liberal-, not most -ideological-. The real corruption kicked off under Obama where every single judgeship was vetted for ideological purity.

Oh, sure. I'm not telling them not to protest, and I'm sure they're earnest.

I'm saying that by the time they get to their destination there are bound to be a lot of "how do you do, fellow truckers?" types in crew cuts, bermuda shorts and wrist watches just champing at the bit for an opportunity to make everybody else look bad and discredit the whole cause. Because that's what they do. Glowies don't usually start shit, they subvert shit that's already ongoing.
 
The thing is a Trucker protest would not even HAVE to go into DC to shut the whole city down. If you look at the map there is a circle interstate that runs around DC called I-495 that also absorbs I-95 (the main road North and South on the East Coast) until north of DC. All you have to do is just get onto I-495, get in all 4 lanes on each side and drive the speed limit. The grindlock would completely destroy any on trying to get into the city while being completely legal.

Tuckers have been doing it in protest since the 90s and it always works.

But dear god I would love to see a bunch of truckers jam their rigs right down I-66 / Route 50 throat. And with the R AG and Gov I don't think they would do shit about it.

Any glow ops can be effectively defused, or at least the blame can be taken off the protesters, if the organizers just tell the participants to behave themselves.

People care about 1/6 in regards to the people being held in the gulags, having their rights stripped from them, and treated like shit for doing nothing at best and at worst loitering. It's unfair what those people are going through.

People do not care about 1/6 in regards to how congress and the left has been making a big fucking deal about it and how they try to stack it up with "muh 6 gorillian" and "NINE-ELEVEN!!!" in regards to worst tragedies ever. It is. Absolutely is. By convincing people online that every offline thing is a trap by the feds they absolutely hamstrung the right from doing anything offline -- and online spaces are de-facto enemy territory, being controlled either by Uniparty interests or radical leftists or both.

But lets not pretend this shit didn't happen less than a year ago.

That event was TRULY both a blessing and a curse for the right.

A blessing in that it proved the right that the feds were indeed fucking with them and trying to destroy their movement from the inside while leaving the left alone to destroy shit.

A curse in that now NOBODY takes any movement the right does seriously because the feds pretty much tainted it, thereby making any meeting/group that's "right" related fake and gay.

How the fuck do you fix an issue like that though?
