US set to launch tariff refund system on April 20​

April 14 (Reuters) - President Donald Trump's administration plans to launch next Monday the system it will use for issuing refunds to American importers for $166 billion the companies paid in tariffs that ‌the U.S. Supreme Court struck down in February as unlawful.
U.S. Customs and Border Protection said, opens new tab in a court filing on Tuesday that it has completed the development of the initial phase of the refund system, known as CAPE. The system will consolidate refunds so importers will receive one electronic payment, with interest when applicable, rather than processing refunds on an entry-by-entry basis.

Agency official ⁠Brandon Lord made the declaration, opens new tab in the filing with the New York-based Court of International Trade. The agency disclosed the CAPE launch date in a separate announcement on Friday.
The Supreme Court ruled that Trump overstepped his authority in imposing sweeping global tariffs under the International Emergency Economic Powers Act, a 1977 law meant for use in national emergencies.
Tuesday's filing said that as of April 9 some 56,497 importers had completed the process to receive electronic refunds for tariffs affected by the court's ruling, an amount totaling $127 billion.
The agency has said it plans to roll out the refund system in ‌phases.

Lord ⁠said in his declaration that the agency is considering options for processing refunds on a subset of entries that were subject to $2.9 billion in tariffs. Lord said these normally would require manual processing, which would dramatically increase the workload and divert personnel from the agency's trade operations and enforcement.
After the Supreme Court's decision, ⁠importers sued for refunds in the Court of International Trade, which is monitoring the development of the refund system.
More than 330,000 importers paid the tariffs at issue on 53 million shipments of imported goods, according to court ⁠documents.
Customs and Border Protection has said the CAPE system will initially process refunds on recently imported goods and straightforward entries.
Many smaller importers feared the cost of the refund process would outweigh the ⁠benefits of trying to get reimbursed, forcing some companies to explore creative financing options related to refunds.

Trump denounced the Supreme Court after its ruling and imposed a new temporary global tariff under a different law, though that also has been challenged in court.

For anyone who gives a shit about tracking developments regarding the reversal of the IEEPA tariffs and the surrounding developments long term, I would strongly advise against trusting the MSM's word blindly, let alone making fallacious accusations of the IEEPA refunds being a new vector for fraud. Importers of Record (IORs) and Customs brokers will be able to file a CAPE Declaration, using a Comma-Separated Values (.CSV) file, through their web-based ACE Secure Data Portal (ACE Portal) account. Filers will not use the Automated Broker Interface (ABI) to file a CAPE Declaration.

The CAPE Declaration consists of the list of entries for which refunds of IEEPA duties are being requested. CBP will not require any other information in the .CSV file. Each individual CAPE Declaration has a limit of 9,999 entries. IORs and brokers can file multiple CAPE Declarations. The CAPE Declaration template file will be available through the “Upload” button in the CAPE tab.

Only the IOR for the listed entries or the authorized customs broker that filed the entries on behalf of the IOR may file the CAPE Declaration.

Once a CAPE Declaration is validated and accepted, ACE will update the appropriate entry summary lines by removing the IEEPA Harmonized Tariff Schedule Chapter 99 provision and the corresponding IEEPA duties, resulting in an updated version of the entry. Following CBP review, entries will be liquidated or reliquidated and refunds will be consolidated by IOR, or by the party the IOR has designated to receive refunds on its behalf via CBP Form 4811 (“Form 4811 notify party”), and liquidation date.

Importers and authorized brokers should anticipate that valid IEEPA refunds will generally be issued within 60 - 90 days following acceptance of the CAPE Declaration, unless a compliance concern requires further CBP review. However, certain scenarios, such as entries that are extended, suspended or under review, and warehouse entries, will maintain their liquidation status with validated refunds issued at liquidation.

Refunds will be issued consistent with applicable laws and/or any applicable court order.



Getting Started​

To provide your refund bank account information, you will need to have the “Importer” sub-account in the ACE Portal. IORs and customs brokers can also begin compiling lists of entries on which IEEPA duties were paid.

Filing a CAPE Declaration​

Processing the CAPE Declaration​

When you file a CAPE Declaration by uploading your .CSV file in the ACE Portal, the file itself, as well as the entry summaries listed, will be validated and you will receive a CAPE claim number. This indicates that the CAPE Declaration is accepted and will continue processing for the accepted entries.

Issuance of Refunds​

All refunds are required to be paid electronically via Automated Clearing House (ACH) (Federal Register Document 2025-24171). To receive a refund, CBP must have your bank information on file. If bank information designated for refunds is not on file with CBP, the refund will not be paid until that information is provided through the ACE Secure Data Portal (ACE Portal).  See more information at ACH Refund Enrollment Overview.

  • Entries designated on a drawback claim
  • Entries covered by an open protest
  • Entries not filed in ACE, and entries without a liquidation status in ACE
  • Entries subject to Antidumping/Countervailing Duties (AD/CVD), for which the Department of Commerce (DOC) has issued liquidation instructions, that are pending liquidation in accordance with 19 U.S.C. § 1504(d)
  • Entries for which liquidation is final.

This is where all customs brokers, freight forwarders, importers, and exporters receive guidance on the latest updates to the US Harmonised Tariff Schedule (HTS), Code of Federal Regulations (CFR), and assorted happenings. Basically, anything that would even nominally impact the flow of cargo in America will first get announced there before trickling down to the MSM. Basically, Reuters, AP, NYT, etc can report about the outcomes of court cases without properly understanding the "how." CSMS is specifically where the "why" and the "how" get announced and broadcast to basically everyone with even the slightest exposure to US Customs.

THERE'S NO FUCKING WAY THAT FRAUD CAN HAPPEN WITH THESE DUTY REFUNDS BECAUSE:
  • YOU NEED TO HAVE ALREADY SUBMITTED AN ENTRY TO US CUSTOMS DURING THE ENTIRE TIME THAT IEEPA WAS IN EFFECT
  • YOUR ENTRY SUMMARY MUST SHOW THE RELEVANT HTS CODE(S) PERTAINING TO IEEPA TARIFFS
  • AND YOU NEED TO HAVE YOUR BANKING INFORMATION SET UP WITH US CBP SUCH THAT DUTIES MAY BE COLLECTED OR REFUNDED THROUGH ACH.

For you to be an importer of record eligible for tariff refunds, you (or your customs broker) would've already needed to submit an entry between Liberation Day in April 2025 to when IEEPA tariffs were overturned and the new 10% ad valorem duties were issued Section 122 of the Trade Act of 1974 in February 2026.

This isn't some amateur fraud scheme like lying to the IRS and state tax authorities because you have until April 15th to cook your books, or claiming that you're a legal immigrant because you have a pending asylum case, therefore you're eligible for Medicaid and SNAP. The world of international trade, specifically B2B trade, is thoroughly documented at every step of the process from the Monday-Friday 9am-5pm business cycle.

There's no fucking way that any fraudster operation can tangibly occur because almost all this shit is so thoroughly documented and automated, with a million fucking eyes on it any given time. What, you wanna file a fraudulent entry and backdate it to before January 2026 when it's already April 2026?! Do you have any idea how many fucking flags that would trip if someone had the fucking hubris to such a thing?

If a business entity gets caught attempting to defraud US Customs, they get slapped with penalties and sanctions that inhibit if not outright kill off any chances they have to import shit. If a customs broker (or a 3PL company that provides customs brokerage services) filed a fraudulent entry like that, their fucking licenses get revoked and they have the penalties and sanctions applied. There's no one fucking brazen or stupid enough to try this.

Oh, you wanna use shell companies? Good fucking luck considering how invasive the process to become an importer is in the USA. You don't just need to provide business information like an IRS#, your mailing address, and your banking info. You also need to have people on the hook to be first contacts, set up single-entry or multi-entry bonds with US customs that guarantee payment of duties, and also have that bond under an official of your company's name. Who the fuck is gonna be willing to become a patsy for a blatant fraud operation like this on multiple levels?! Especially when sanctions and penalties are at stake here?!

And the cherry on top is the additional overheard created by the government having to administer the operation to "give the money back" to the people who already passed the costs along to consumer in the first place.
