one look at fantano's preferred genres to review should tip you off that he's a hack. he only reviews nigger bop or college faggot music, nothing actually cutting edge or heavy.

Activision used the "enough slices" clip by Fantano, which he had uploaded to TikTok, in a video about Crash Bandicoot sneakers. They are suing him proactively because they claim he is engaged in a "scheme" of threatening to sue people who use the clip without his permission. Activision themselves claims to have gotten the clip from TikTok's commercial library, and they say this shows Fantano does not own the rights to the clip.

I have to go so I can't do a really deep dive into this but if more legal-minded Kiwis want to have a look, go nuts.
 
A declaratory remedy won't result in monetary loss on its own (other than attorneys' fees). At this point it seems to only be preempting any potential lawsuit by Fantano by having the court basically declare that he has no basis for a lawsuit given the circumstances. Which is unfortunate because anyone who employs Tik Tok to draw child viewers deserves to be drawn and quartered financially.
